Near misses are one of the most ‘creatively’ reported areas of construction. Reporting expectations mean zero near misses look suspicious, so teams either invent low-impact incidents to tick the box or under-report genuine risks.

If an incident occurs and technology existed that could have detected or reduced the risk, regulators may argue the constructor had the opportunity to act and didn’t. The Victorian Government recently warned that these situations can escalate to manslaughter charges.

There’s also cultural fallout. When operators feel watched rather than supported, they resist reporting, bypass systems or avoid engagement altogether. Leadership ends up making decisions based on partial, inaccurate or entirely fabricated safety data.
